Making a late push for ugliest celebrity divorce in recent memory, Gossip Girl star Kelly Rutherford has been granted a temporary restraining order against her estranged husband the father of her two kids, Daniel Giersch.

She's accusing him of intimidating and threatening her nanny.

He was also being inflexible with his scheduled custody visits and stressing her out so much she's having a hard time breastfeeding, according to the actress.

In a lengthy declaration filed Thursday in Los Angeles Superior Court, Rutherford states that Giersch doesn't comply when she wants to take their 3-month-old daughter Helena to work with her so that she can nurse.

"From time to time I have some extra milk, but I never know when that will be... I believe that the stress Daniel has created for me is also negatively impacting my ability to produce milk," said the 40-year-old Kelly.

Giersch said in his own court filing Thursday that Kelly Rutherford is the one switching up visits on him and he has "concerns that Kelly, her caretakers, and Kelly's mother are causing immediate harm to [their] children."

But he's the one who's got to lie low for awhile - at least 100 yards away from Rutherford, Helena and their son Hermes, according to a judge.

A hearing on the matter is set for October 15. Rutherford was pregnant with Helena when she filed for divorce in January. She recently gave birth, and is currently on maternity leave from Gossip Girl.

As One Tree Hill (2.5 million viewers, 1.2 share) managed to maintain its premiere rating Monday, Gossip Girl (2.1 million, 1.1) faltered in the 9 p.m. slot.

The ratings were down 21 percent from the season premiere, which was down even more significantly than that from the previous season's first episode.

To a point, we could not care less as long as the show remains on the air, and there has been zero indication from the CW that Gossip Girl is in jeopardy.

But on the flip side, a drop in ratings that were never super-high to begin with is somewhat alarming for a show that gets the amount of buzz GG does.

We love it like no other, but because we want to help Gossip Girl ensure a long, bright future, we can't help but wonder if improvements are needed.

That said, we're curious for your opinions on the following questions:

• Do you think the show has gone downhill? If so, why?
• What, if anything, can and should be done to fix it?

Here is a little piece of Chair news from TV Guide's spoiler column today.

Will you like it? Does it foretell bad things? Depends on how much you read into it, but we'd imagine that things are pretty much par for the course with Chair.

Q: On Gossip Girl, Chuck and Blair's "games" are definitely going to end badly this season, aren't they?

A: It depends on how you define badly.

Will they enter a murder-suicide pact? Probably not. Will they break up? Oh, sure, probably several hundreds of times this season alone.

"It just gets crazy. They're like on and off, but it's hot," teases Leighton Meester.

LovelyLively: Gotta go with this: G: "Jesus and I have redefined our relationship." B: "You mean he dumped you because He found out you were Satan!"

Gossip Guy: Hehe, I loved when Chuck compared a college degree to an accessory like a Malawi baby or a poodle. Nice. A close second was Blair's general shock when she heard that Dan was a writer.

Mister Meester: The exchange that almost made up for a Chair-less episode, with Blair crawling in bed next to a sleepy Chuck and saying "You were right about the dorms. The lighting is awful. You okay?" Chuck's reply? "I am now."

2. Who do you trust least, Carter, Scott or Georgina?

LovelyLively: Carter. This guy was a shady character for first two seasons, and now we're supposed to believe he has no agenda? Not buying it ... he's hot though.

Mister Meester: I can't figure Scott out and Carter seems genuine with Serena, so I'm taking Geor-gi-na. We all know she's a head case just looking for an excuse to forget to take her meds one day, causing all hell to break loose.

Gossip Guy: Absolutely Scott. It may just be his absolutely horrible acting, but it seems like that man is hiding more than just the fact he's Rufus and Lily's kid.

Nate and Bree Buckley were getting pretty cozy last night on Gossip Girl, but could he be reuniting romantically with Vanessa a little later this season?

We don't know for sure, but Chace Crawford and Jessica Szohr were seen on the waterfront while filming scenes for Gossip Girl in New York City Monday.

Might sparks fly again for NV?

A number of photos have been emailed to us from the Gossip Girl set this week. From what we've gathered, there is a drowning scene - someone drowns or at least comes close to it - in the fifth episode of the current season.

That would be "Rufus Getting Married," airing Monday, October 12.

The picture below shows the cast and crew apparently at the edge of a pier, though it is not known where the scene is supposed to take place or who goes in the drink (though someone in a suit looks poised to dive in).

A stunt double for Chuck or Nate maybe? What do you think?

UPDATE: Thanks to our readers for the new intel and theory that this is Nate's cousin Tripp, and the episode in question is actually "The Grandfather, Part II," the eighth of the season and scheduled for a November 2 airing.
