Kelly Rutherford Looks Happy, Very Pregnant

Let the baby countdown begin!

With just days to go before she celebrates the birth of her daughter, Gossip Girl star Kelly Rutherford picked up some reading material while enjoying an evening out in Beverly Hills Thursday. Nice to see her smiling amid her ongoing divorce drama.

Kelly Rutherford Divorce Takes Surprising Twist

While they both stated in January they'd try to handle their split amicably for the sake of their two-year-old son and their second child on the way, Gossip Girl actress Kelly Rutherford and estranged husband Daniel Giersch are facing off again.

You won't believe why.

Rutherford, 40, claims their son, Hermes, is in danger because Giersch, 34, leaves the swimming pool uncovered at his Los Angeles home. She knows this because she hired a private eye last week to conduct three days of video surveillance on him.

"Hermes is very young, very active, not water safe and in a moment's notice, could fall into the swimming pool," Kelly Rutherford warns in a court filing.

Although video footage does confirm the pool was uncovered over three days, nothing egregious was witnessed, according to the investigator's reports.

"Hermes is not in any danger whatsoever with regard to my pool because I have the pool fully covered with an automatic pool cover," Giersch states in his filing. "Hermes has no access to the pool area unless I take him to the pool myself."

Regardless, on Tuesday, a court ordered Daniel Giersch to keep his pool covered at all times unless Giersch is personally close by.

Meanwhile, a hearing Friday will address the couple's differences over whether it's too stressful a time to potty train Hermes while his parents are in the midst of a divorce and custody battle and since the child is about to become a big brother.

Rutherford, who's pregnant with the ex-couple's second child, a girl, is due to give birth in three weeks. If there's any silver lining here, it's that at least Lily van der Woodsen can be filmed from the neck down on Gossip Girl next season.

Kelly Rutherford Trying to Stay Positive

She may be going through a nasty divorce with estranged husband Daniel Giersch, but Kelly Rutherford is staying positive and focusing on being a parent.

"I'm doing great," the pregnant actress told People.

Asked about how she remains upbeat despite the struggles in her personal life, she says, "I'm doing so well because I know I'm making the right decision."

"I love my son so much and he's loved by both us - his father and I - greatly," she added. "My greatest joy in life right now is being a mom."

In January, a Los Angeles court sided with Rutherford, allowing the star to take son, Hermes, 2, to N.Y. City, where her show is filmed, until the end of March.

Giersch strongly objected, saying his home in L.A. offers a more stable environment. Still, he said he and Kelly would work to create a stable life for Hermes.

Kelly Rutherford Will Return to Gossip Girl on Schedule

A judge has officially ruled that Kelly Rutherford, who is going through a nasty divorce battle, can take her son to New York while she films Gossip Girl.

Rutherford is due back to work on January 27, and had said that she was prepared to stay in L.A. with son Hermes, 2, no matter the consequences she might face as a result, if she was not permitted to go to New York with him.

These developments led to speculation that her character, Lily van der Woodsen, may have to be written off Gossip Girl, but all seems well for now.

But the judge ruled Rutherford can leave as planned on Sunday and that Kelly's estranged husband, Daniel Giersch, is free to travel there as well. Giersch argued that he needed to stay in L.A. to conduct business, but the judge was not having it.

Kelly Rutherford filed for divorce from Giersch, an entrepreneur, on December 30. The Gossip Girl actress is also four months pregnant with the couple's second child.

Giersch was awarded two overnight visits per week for the month of February and three per week for March. All three need to be in L.A. for a minimum of four days.

Hermes will be alternating time between the two parents in both cities while they try to hammer out a long-term custody arrangement that suits all parties.

Gossip Girl star Kelly Rutherford, who plays Lily van der Woodsen, claims in her escalating divorce battle that her estranged husband is an ominous, violent man who is bad news for her, not to mention their two-year-old son, Hermes.

Rutherford filed legal papers that the judge will consider tomorrow in a hearing. Rutherford's estranged husband, Daniel Giersch, wants the judge to prohibit his soon-to-be ex-wife from taking two-year-old Hermes to NYC to film the show.

Rutherford claims Giersch has gotten into big arguments with her, in one case allegedly coming at her. She says he's an avid boxer and kickboxer and she's "intimidated."

She also he threatened to "teach her a lesson" by taking the child.

Kelly Rutherford - who is four months pregnant now (fairly obvious in some shots from last night's episode, "You've Got Yale," though not part of the script) says it's gotten so bad she called the cops twice and he's been forced to leave.

Daniel Giersch has claimed the kid is totally stressed out around Rutherford and that she can't be a real mom because her shooting schedule is insane.

She says that's just not the case. No word yet on whether the court's upcoming ruling will impact her schedule for filming Gossip Girl. More to come ...

Kelly Rutherford Divorce Fight May Impact Gossip Girl

Kelly Rutherford, who plays Lily van der Woodsen on Gossip Girl, is currently going through an ugly divorce with her husband of two-plus years, Daniel Giersch, with whom she has a two-year-old son, Hermes. And it's getting uglier still.

Here's the problem: Sources on Gossip Girl tell celebrity news site TMZ that Rutherford is supposed to be in New York to shoot scenes by January 27.

Kelly went to court last week and pleaded with the judge in the divorce case to let her go to New York City with Hermes to resume filming the series.

Daniel Giersch doesn't want Hermes to travel to NYC because he claims Kelly works insane hours and gets totally stressed out when she's shooting.

The judge shut Kelly down, telling her he'll take the issue up a week from today. If the judge shuts her down next week, she'll miss work on the show.

Gossip Girl producers could deal with a small delay and shoot Lily VDW out of sequence, but if the delay is longer they could just shoot her - as in her character.

Kelly is also pregnant with their second child - a fact revealed very shortly before the couple announced its separation. Hopefully this gets straightened out - both personally and professionally - as well as it can for Kelly.

The impending divorce between Gossip Girl actress Kelly Rutherford and her husband has turned ugly, with the star who plays Lily van der Woodsen seeking to bar him from leaving the U.S. with their 2-year-old son for fear they'll disappear.

Daniel Giersch countered in L.A. Superior Court with papers alleging the actress, who's four months pregnant with their second child, has a bad temper, once throwing a laptop at him and another time trying to sock him with her fist.

Rutherford, 40, filed for divorce from Giersch, an entrepreneur, last month after being married just over two years, seeking sole physical custody with monitored visitation.

On the same day, Giersch filed for legal separation from the actress, seeking sole legal and physical custody with visitation for her.

In emergency papers filed January 9, Kelly Rutherford sought to bar Giersch, 34, from traveling outside the U.S. with their son Hermes.

"I feel there is some risk that he will leave the country with Hermes and I will not know where they are," Rutherford said, adding that during their marriage, he told her of a pending investigation in his native Germany that could lead to his arrest.

Kelly Rutherford to Separate From Husband

Pregnant Gossip Girl star Kelly Rutherford and her husband of two years, German entrepreneur Daniel Giersch, are calling it quits, according to People.

Rutherford recently announced that she is three months pregnant.

The 40-year-old actress, who plays Lily van der Woodsen on Gossip Girl, formally filed for divorce on December 30, citing "irreconcilable differences."

Giersch filed for legal separation the same day, a source reports.

Despite the upsetting development, Kelly Rutherford is expected back on the Gossip Girl set as scheduled in New York City on Tuesday, sources report.

The couple already have a two-year-old son, Hermes. This is Rutherford's second marriage. She wed Carlos Tarajano in 2001 and divorced in 2002.

The Gossip Girl writers have been given ample notice, but how will actress Kelly Rutherford prepare her own son Hermés, 2, for a new sibling?

"My husband [Daniel Giersch] actually found some really cute books about explaining to your kid about the baby that's coming and the mommy being pregnant and what goes on with the mommy and then what happens when you bring the baby home," the pregnant Rutherford, 40, told People. "It's really helpful."

While her pregnancy has already had a big impact on her daily life, Kelly Rutherford doesn't see it impacting her Gossip Girl character, Lily van der Woodsen.

"I told [the writers] pretty much as soon as I found out, so they had some time to think about it," she says. "But they have so many great storylines going right now. I think they decided to go with [them]. I'll only be I think about six months pregnant when we go on hiatus so it shouldn't be too difficult to figure out and work around it."

Rutherford isn't the only Gossip Girl star making headlines. On Thanksgiving weekend, Ed Westwick and Jessica Szohr were spotted smooching while waiting for a flight.

"I've got a scene with Ed tonight," Rutherford joked about her fellow Gossip Girl cast member. "I'm gonna give him a hard time about it. I love it. I love hearing gossip."
